　　今天（5月5日）记者获悉，前不久，扬州市民周某被公司调岗，她觉得太远了于是拒绝上班，结果被公司开除。事后，她将公司起诉至法院，要求经济补偿，那么，法院会支持吗？　　2019年12月，周某入职扬州某公司，合同约定公司安排周某在“扬州县市”担任促销员。周某入职后，被安排在扬州市区某超市工作，此后工作地点一直未发生变化。2022年5月15日，公司向周某送达《调岗通知书》，通知周某到宝应某超市工作，收到通知后3日内要到新店报到，逾期视为旷工，岗位仍是促销员。　　扬州经开区法院少年及家事审判庭员额法官王睿冰介绍：“宝应与扬州市区距离较远，对于周某的出行是很不便利的，超市并没有通过事先征求意见或者事先告知等程序与周某沟通，而是直接下达通知。”　　周某觉得距离太远出行不便拒绝调岗，也未到宝应的超市报到，此后也未再上班。2022年5月21日，公司以周某旷工超过3日为由开除周某。　　扬州经开区法院少年及家事审判庭员额法官王睿冰说：“周某以违法解除劳动合同向法院起诉，审理中我们认为劳动合同是约定了工作范围在扬州大市范围内，公司把周某安排在宝应县本身不违法。但是合法的同时调岗还需要合理 。”　　法院认为，公司作出调岗前未征求周某的意见，也未考虑周某上班的时间、交通成本的增加，未对周某的交通、住宿等进行安排，甚至通知周某“次日”即前往新岗位报到，未给予周某出行准备的机会，所以本次调岗缺乏合理性。周某因不合理的调岗拒绝上班，最终被辞退，符合主张经济补偿的法律规定。王睿冰说：“判决支持了周某的诉讼请求，认为本次是违法解除合同，公司支付经济赔偿金。”　　（《零距离》记者/冯珂 实习编辑/李冉）来源：荔枝网下载荔枝新闻APP客户端，随时随地看新闻！新浪微博
